The agreement

These terms govern your use of Beneath SiteReport, the reports it produces and the account it keeps for you. By running a check, buying a report or creating an account you accept them. If you are accepting on behalf of a brokerage, a firm or another organisation, you confirm you may bind it.

SiteReport is a product of Beneath. Where these terms are silent, the Beneath terms at usebeneath.com apply.

What the service does

You name a property in Texas. We locate it, gather the public well records, groundwater database entries, parcel data and terrain around it, and compose a report: the wells on record, the depth to water the records support, the aquifer and district context, and what only the seller or a title company can confirm. Every claim in a report carries the status of its evidence.

Depths, yields and costs are modelled ranges from public records, not measurements, tests or quotes. Read the report disclaimer before you act on a report; it is part of these terms.

Reports, credits and payment

A Water Due Diligence Report and a Drill-Ready Report are bought once, for the one property they name, at the price shown before you pay. A subscription (Beneath Pro, Pro Studio) grants a monthly allowance of report credits; a report costs the credits the pricing page states, and credits past the allowance are billed at the plan's overage rate at the close of the cycle. Credits do not roll over.

Paddle acts as merchant of record and issues the invoice. Subscriptions renew automatically until cancelled, with effect from the end of the current cycle. Prices may change with at least thirty days' notice before your next renewal.

A report that fails to generate is not charged: a one-time purchase is refunded and a credit is returned. Beyond that, payments are non-refundable except where the law requires otherwise. A refunded report is withdrawn, and any share links to it stop working.

Buying before you have an account

You may buy a report without signing in. The report is attached to the browser you bought it in until you sign in with the email address you paid with, at which point it is attached to your account. We hold that address for that purpose. A report nobody claims stays private to the browser that bought it.

What you may do with a report

The report is yours to use in the transaction or the project it relates to: you may share it with your client, your agent, your lender, your driller or your attorney, and you may include its findings in your own advice. A share link you create is under your control and can be revoked at any time.

You may not resell reports, offer them as a product or service of your own, or bulk-extract their contents, except under a Studio plan's white-label terms, which permit your name on reports you deliver to your own clients. You may not present a report as a survey, a well test, a title search or a legal opinion.

Seller disclosures and legal matters

A report organises public evidence relevant to a Texas seller's disclosure. It does not complete, sign or stand behind a disclosure, does not state what a seller knows, and does not determine the ownership or severance of water rights. Nothing in a report is legal advice.

Teams

A workspace owner or admin may invite others at a role. Owners and admins manage billing and branding; members run reports; viewers read them. Each account is responsible for what is done under it, and the workspace owner for the workspace.

Your account

Keep your sign-in secure and tell us promptly if you think it has been compromised. Do not use the service unlawfully, do not attempt to breach its security, and do not run checks on properties you have no legitimate interest in. We may throttle checks and reports to keep the service working for everyone.

Intellectual property and public records

We own the service, the models and the software. You own your account, the properties you save and the reports you buy. Public records reproduced in a report remain public records, credited to the agency that published them; no agency endorses or reviews Beneath.

Warranties and liability

The service is provided as is. We do not warrant that a report is complete or accurate, that public records are correct, that water exists under any property, or that the service will be uninterrupted.

To the fullest extent permitted by law, we are not liable for the outcome of a transaction, drilling costs, dry holes, lost yield, lost profit or any indirect or consequential loss. Our total liability in any twelve month period is limited to the amount you paid us in that period. Nothing here excludes liability that cannot lawfully be excluded.

Suspension, termination and changes

You may close your account at any time. We may suspend or close an account that breaches these terms or puts the service at risk, or where payment has failed and remains unpaid after notice. Reports you bought remain available for the period the privacy policy states.

If we change these terms materially we will say so by email or in the application before the change takes effect. These terms are governed by the law that governs the Beneath terms. The date at the top of this page is the current version.
